YOU HAVE 15 DAYS FROM THE DAY OF YOUR ARREST TO CALL THE DEPARTMENT OF PUBLIC SAFETY IN AUSTIN AND REQUEST A HEARING!!

SATURDAYS AND SUNDAYS ARE COUNTED IN THIS NUMBER (15 DAYS).

If you contact THE DEPARTMENT OF PUBLIC SAFETY in Austin within the 15 day
time period and request a hearing, your drivers license will NOT be suspended
until the day of the hearing. *(If you win the hearing,your drivers license will not be suspended for the breath test failure or refusal.)

If you fail to request a hearing within 15 days of your arrest, your drivers license is suspended automatically on the 40th day after your arrest.

NOT REQUIRED FOR OCCUPATIONAL LICENSE

*NOTE: If you took a blood test, the law is different. If you took a blood test, THE DEPARTMENT OF PUBLIC SAFETY will notify you when they receive the results of the blood test. MAKE SURE YOUR ADDRESS IS CORRECT ON YOUR DRIVERS LICENSE. This letter wil not be forwarded. If your address is not correct, you must call THE DEPARTMENT OF PUBLIC SAFETY in Austin and make sure they have your correct address.

Once notified of your blood test failure, (.08 or above), you will have 15 days from the date of that letter to request a hearing.
